The GOOD Party is appalled, but not surprised, by Deputy Mayor Gary van Niekerk’s decision to leave South Africa on the eve of his criminal trial. This brazen act of evasion is just the latest chapter in a long and sordid story of impunity, enabled by a complicit and lethargic coalition.
Van Niekerk’s failure to appear in court left the presiding magistrate rightfully “frustrated”, and a warrant of arrest has now been issued. He will be required to appear in court next month to explain why he should not be held in contempt.
This latest incident reinforces everything the GOOD Party has said during Van Niekerk’s tenure. Gary van Niekerk has no respect for the law, no commitment to ethical public service, and no business occupying any position of leadership in Nelson Mandela Bay.
In this latest case, he faces serious criminal charges related to cybercrime and the contravention of the Municipal Finance Management Act, following irregular expenditure of over R570,000 on legal fees for personal and party-political purposes.
Previously, a multi-party ethics committee unanimously found him guilty of breaching the councillor Code of Conduct. He has a pattern of misconduct, including abusing municipal vehicles, dodging council duties, and undisclosed overseas travel while serving as Mayor.
The ANC-EFF-led coalition in Council has actively shielded van Niekerk from consequence. The MEC for Cooperative Governance, Zolile Williams, has failed to act decisively, despite formal findings and multiple red flags.
The people of Nelson Mandela Bay deserve better than a Deputy Mayor who flees the country to dodge justice.
