Advocate Andy Mothibi possesses the credentials and track record to make an excellent National Director of Public Prosecutions.

He is an experienced prosecutor who has led the Special Investigations Unit with admirable success. The SIU, under his leadership, has recovered Billions of Rands looted from the State while avoiding the stench of political interference and corruption that have permeated other key components of the country’s criminal justice system.

Adv. Mothibi assumes the prosecutorial reins, from 1 February 2026, at a dramatic time. Last year, President Ramaphosa established a judicial commission to investigate the non-prosecution of apartheid-era crimes referred for prosecution by the Truth and Reconciliation Commission. The commission is presently trying to fend off separate applications for the recusal of its chairperson, retired Judge Sisi Khampepe, by two former Presidents, Mbeki and Zuma.

As the new NDPP, Mothibi also becomes a respondent alongside the President and Minister of Justice, in damages claim brought by the families of victims of apartheid-era crimes.

Meanwhile, the Madlanga Commission and a Parliamentary Ad-Hoc Committee are investigating allegations of corruption across the criminal justice system raised by KwaZulu-Natal Police Commissioner Nhlanhla Mkhwanazi.

As the head of the SIU, Adv. Mothibi has the vital experience of leading an integrated and motivated crime-fighting unit. All this experience, and more, will now be required to repair long-term damage and restore the integrity and efficacy of the National Prosecuting Authority.
We have high hopes in Adv. Mothibi and wish him all success.

It is regrettable that Adv. Mothibi was not shortlisted for the NDPP job and subjected to a public interview alongside the other candidates last year. One doesn’t need the foresight of Nostradamus to predict that allegedly corrupt politicians engaged in lawfare with the State will be closely weighing the appointment process for both its political and so-called Stalingrad potential.
